House of Tierce is a U.S.-based art dealership that curates and sells original artworks by emerging artists. We act as a non-exclusive representative for artists, meaning each artist remains free to sell their work through other galleries, dealers, or personal channels.
All artworks featured on the Site are either consigned to House of Tierce by the artist or sold on behalf of the artist under a non-exclusive agreement.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase artwork or use our Services. Users under 18 may use the site only with the involvement and consent of a parent or legal guardian. By accessing the Site, you represent that you meet these requirements and are legally capable of entering into a binding contract.
3. Intellectual Property Rights
All content on this Site—including but not limited to images, artworks, text, logos, graphics, layout, and design—is the property of House of Tierce, its artists, or licensors, and is protected by U.S. and international copyright, trademark, and intellectual property laws.
You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any part of this Site or its contents without written permission from House of Tierce or the applicable rights holder.
You may, however, share or repost artworks for non-commercial purposes (e.g., social media) provided that proper credit is given to the artist and House of Tierce, and no modifications are made to the original image.
4. Artwork Listings & Representation
Each artwork listed on the Site includes details provided by the artist or verified by House of Tierce. While we make every effort to ensure accuracy, we do not guarantee that images, descriptions, or dimensions will perfectly reflect the physical artwork. Colors and textures may vary due to lighting and screen display differences.
All artworks are sold subject to availability. Because we represent artists non-exclusively, an artwork may be sold through another channel before your transaction is processed. In such cases, we will promptly notify you and issue a full refund.
5. Pricing & Payment
All prices are listed in U.S. Dollars (USD) unless otherwise noted. We reserve the right to change prices or correct errors at any time.
Payments are processed securely through authorized payment processors. By submitting payment, you confirm that you are authorized to use the selected payment method. House of Tierce reserves the right to cancel any order suspected of fraud, error, or unauthorized use.
6. Shipping & Delivery
Shipping timelines, methods, and insurance coverage are outlined in our Shipping Policy, which is incorporated by reference into these Terms. Risk of loss or damage transfers to the buyer once the artwork is delivered by the carrier, unless otherwise specified in writing.
International purchases are not available at this time.
7. Returns & Refunds
Due to the unique and original nature of the artworks we sell, all sales are final unless otherwise stated in our Return & Refund Policy. Exceptions may apply only in cases of shipping damage or fulfillment error.

8. Artist Representation
House of Tierce represents artists on a non-exclusive, commission-based basis. The artist retains ownership of the intellectual property rights in their artwork unless expressly assigned in writing.
When an artwork is sold, House of Tierce receives a commission as agreed upon with the artist. Artists are responsible for ensuring that artworks consigned or listed with House of Tierce are authentic, original, and free of third-party claims.
9. User Conduct
When using the Site, you agree not to:
Engage in any unlawful, fraudulent, or harmful activity;
Post or transmit malicious code, spam, or misleading information;
Interfere with the Site’s security or functionality;
Impersonate another person or misrepresent your affiliation;
Copy or scrape content, listings, or images for commercial use.
We may restrict or terminate access to any user who violates these Terms or misuses the Site.
10. Disclaimer of Warranties
The Site and Services are provided “as is” and “as available.” House of Tierce makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Site, the Services, or the artworks listed.
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, House of Tierce, its owners, artists, affiliates, and employees shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site, Services, or purchase of artworks.
Our total liability for any claim shall not exceed the total amount paid by you for the artwork in question.
12. Indemnification
You agree to defend, indemnify, and hold harmless House of Tierce, its affiliates, artists, and representatives from and against any claims, damages, losses, or expenses (including attorney’s fees) arising out of your violation of these Terms or misuse of the Site.
